OBJECTION TO TRIAL COURT’S CLERK

FAILURE TO PROVIDE TIMELY AND ACCURATE NOTIFICATION

Comes now, _____________, pursuant to Mo. S. CT. Rule 43.01(g), and asks that the honorable Court of Appeals Southern District issue such order to compel the clerk of the 29th Judicial Circuit, Kathleen McGuire, provide timely and accurate notification of all Court orders issuing out of said court in the above captioned case, CV295-367 DR, to which this appeal originates. Specifically, appellant objects to the Trial Court Order concerning Appellant’s MOTION FOR NUNC PRO TUNC ORDER TO CORRECT AND CERTIFY THE RECORD ON APPEAL, not being mailed to the appellant in such a timely fashion. It should be further noted that the appellant is not allowed to enter into the county of Jasper, State of Missouri per bond stipulation issued by the trial court in another action, Cr 497-1357FX, as maintained in the appellant APPLICATION FOR EXTENSION OF TIME TO FILE LEGAL FILE , file stamped 10-9-97 Missouri Court of Appeals, Southern District. Further, for the trial court’s clerk to neglect to notify the appellant of the trial courts order on said motion does deny appellant the ability to refute or instigate the proper legal process to correct appellant’s perceived miscarriage of justice. In telephone conversation with the court’s clerk on November 13, 1997 appellant was informed that an order was issued on the aforementioned "Nunc Pro Tunc" motion, and that notification of the appropriate docket entry was being sent via U.S. mail to the appellant.. As of this date, November 18, 1997 notification has been received via fax transmission at 14:06. In that the appellant is presently barred from entering the county of Jasper, State of Missouri, the failure of the trial court’s clerk to provide timely service of the courts orders pursuant to Mo. S. CT. Rule 43.01 is in fact attempt on the part of the trial court to deny access to said court and said rulings. This the appellant feels is a violation of the 5 Th amendment to the constitution of the United States.
