Factual Background: (Events Giving Rise to Cause of Action)
This is an appeal from the Judgment of Dismissal issued on June 19, 2002. Judgment was issued pursuant to Mo.S.Ct. Rule 61.01 as sanctions against the Plaintiff/Appellant in default manner. The Action before the court was Petition for Declaratory Judgment pursuant to Chapter 610 RSMo.

ISSUE(S): (Anticipated to be Presented by the Appeal; Appellant is Not Bound by this Designation.)
The Trial Court did abuse it descretion in that it issued default judgment against the weight of the evidence. The judgment of dismissal does mis apply the law. The judgment of dismissal does apply the wrong law.
