I am writing in response to your letter requesting records pursuant to Chapter 610, RSMo.
In reviewing your request I am unable to provide the information requested for the following reasons. The application form for a driver license is not available as a record subject to disclosure pursuant to Chapter 610, RSMo, prior to being completed. The application does not exist as a separate document, but is part of a licensing program developed for the computers in a license office. Once you apply for a license then a record of that transaction is created and maintained as a separate identifiable record.
Policies and procedures regarding driver licensing and the legal department as you request do not presently exist in electronic format. Pursuant to Section 610.029, RSMo, a government agency is encouraged to provide access to records kept in electronic format but not required to convert records to electronic format. Also, it is not clear from your request what specific policies and procedures you are requesting and that is needed in order to determine how best to provide the information. Additionally, there is no oath of office for Department of Revenue personnel.
As previously indicated, the only applications for driver license on file with the department are those completed on specific individuals. Because of the privacy provisions in Section 32.091, RSMo, those records are not public records. In order to obtain personal information on specific drivers you must show you qualify to receive the information under Section 32.091.
I am aware that you have expressed concern in a recent e-mail about obtaining a response to your request. However, based on phone conversations and e-mail it appears representatives of the department have been in contact with you during the time you were awaiting a response to your request.
